Lucid Green Inc. (“Lucid,” “we,” “us” or “our”) recognizes the importance of protecting the privacy of our online visitors. It is our intent to balance our legitimate business interests in collecting and using information received from and about you with your reasonable expectations of privacy. The following privacy policy (“Privacy Policy”) is the way we handle information learned about you from your visits to our website available at https://www.lucidgreen.io/ (the “Site”) and use of our mobile device applications (the “Apps”), together with all content, functionality and Site offered by Lucid on or through the Site and the Apps, collectively, the “Platform”).
PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you submit information to or through the Site, you consent to the collection and processing of your information as described in this Privacy Policy. BY ACCESSING AND/OR USING OUR PLATFORM OR BY COMMUNICATING WITH US IN ANY MANNER, YOU REPRESENT AND CONFIRM THAT YOU HAVE READ AND UNDERSTAND THIS PRIVACY POLICY. We currently only accept business and Site visitors within the United States. IF YOU ARE LOCATED OUTSIDE THE UNITED STATES, OR IF YOU DO NOT AGREE WITH ANY PART OF THIS PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO USE THE SITE OR THE PLATFORM (as defined in the Terms of Use).
Business Partner Data
Our Platform is designed to help our business partners who are manufacturers and retailers of cannabis products (“Business Partners”) communicate directly with their customers, increase supply chain efficiency, and provide greater visibility into their inventory.
Most information collected by Lucid Green through the Platform is done so on behalf of our Business Partners. Those Business Partners are therefore ultimately in charge of how such information is being used. We refer to such information in this Privacy Policy as “Business Partner Data.” When you scan an Item ID (currently presented as a QR code) relating to our Business Partner products, you may submit requests relating to your information to that direct Business Partner.
Business Partner Data may include information related to the products you purchase and information relating to your use of their products for analytics and marketing purposes. We collect and handle Business Partner Data in accordance with our agreements with our Business Partners.
To learn more about how our Business Partners treat your Business Partner Data, please visit those partners’ websites and privacy policies. We are not responsible for how our Business Partners process your Business Partner Data.
To the extent we combine Business Partner Data with information we collect on our behalf through the Platform, we will treat that combined data in accordance with the practices described in this Privacy Policy, plus any additional restrictions imposed by our Business Partners.
Collected Information
Company collects personally identifiable information from you when you interact with the Site and the Platform. This information is collected and stored electronically by us. This information may include information provided to us voluntarily by you as well as information collected automatically by us from you.
1. Information Voluntarily Provided By You
Depending on how you interact with the Platform, the nature of your communications with us, and our relationship with third-party partners, including our Business Partners, we may collect information about you when you use the Site and Platform or interact with us offline, including information you provide when you register an account, update your profile, browse our web site, access our content, redeem rewards points, participate in a promotion, or contact customer support. Such information includes or may include:
Contact Data, including your first and last name, email address, postal address, and phone number.
Account Credentials, including your username, and information for authentication and account access.
Demographic Data, including your age, gender, and country.
Profile Data, including your interests, inferences, preferences and favorites.
Content, including content within any messages you send to us and to the vendors that are included in the Site and Platform (such as feedback and questions to customer support) or post via the Site, both publicly and privately (such as in product reviews or blog comments), and scanned Item IDs sent through the Platform.
You may choose to voluntarily provide other information to us that we do not request, and, in such instances, and in such situations we have no control over what categories of personal information such disclosure may include. Any additional information provided by you to us is provided at your own risk.
2. Information Collected Automatically
In addition, information about your computer hardware and software is automatically collected by Lucid when you use the Site and Platform. This information may include: your IP address, browser type, domain names, access times, geographic location, referring website addresses and other technical information such as protocol status and substatus, bytes sent and received, and server information. We may also collect information about how you interact with the Site and Platform. This information is used by us for our business purposes, including business purposes for the information collected automatically, e.g., for the operation and improvement of the Site and Platform, for technical troubleshooting, to maintain quality of the Site and Platform and to provide general statistics regarding use of the Site and Platform, as well as for the business purposes of and to otherwise service our Business Partners.
3. Information Collected From Third Parties, including:
Business Partners who may provide us information about how you use our Platform, engage with their products, and your interests.
Service Providers such as advertising, marketing, data analytics, internet providers, fraud prevention services, advisors, and related partners who may provide us with your information to facilitate their services.
Public Sources such as government sources and/or news sources who may provide information, from time to time, that is generally available to the public.
Cookies and Other Information Collection Tools
What are cookies? A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.
Duration of Cookies. We may use “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erase them. Persistent cookies have varying durations that are dependent on their expiration date.
What are Device Identifiers? A device identifier or Device ID is a unique, anonymized string of numbers and letters that is stored on a mobile device and that identifies the mobile device. It is stored on the mobile device and can be retrieved by any installed or downloaded app. Apps may retrieve the ID for identification when communicating with servers.
What are Mobile Advertising Identifiers? A mobile advertising identifier or Mobile Ad ID is a unique identifier that enables data to be pseudo-anonymously be tied back to the mobile phone where it was collected. Mobile phones include APIs that allow developers to collect data about the phone itself as well as the phone's usage patterns.
What types of information collection tools do we use? Lucid uses:
Cookies. Cookies collect information about how you have used the Site and Platform in the past and allow the Site and Platform to remember the choices you have made. Some cookies are necessary for you to browse the Site and use its features, and when you use the Platform, such as accessing secure areas of the Site. Cookies allow us to improve how the Site and Platform works for you and tailor the Site and Platform to your preferences. Without certain cookies, some aspects of the Site or Platform may not be available to you.
Statistics Cookies. These cookies collect information about how you use the Site, such as which pages you most often visit on the Site, the time you spend on the Site, which links you click on, and any issues encountered. These cookies help us understand how visitors interact with the Site. All information collected is aggregated and does not identify you.
Device IDs and Mobile Advertising IDs. These IDs are used to identify the mobile devices that are used to deploy the Apps and communicate with the Site and the Platform..
Why do we use them? Cookies help us improve the Site and Platform by providing us with information about which parts of the Site and Platform are most popular, enabling us to analyze technical and navigational information about the Site and Platform, and helping us to detect and prevent fraud. We also use cookies and other data collection tools (such as web beacons and server logs) to help improve your experience with the Site and Platform. For example, we use tools and programs offered by Segment.io, Inc. to help analyze how users use the Site and Platform. These tools use cookies to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Site and Platform (including IP address) is transmitted to our data collection tool service providers. This information is then used by us to evaluate visitors’ use of the Site and Platform and to compile statistical reports on website activity for Lucid.
How do I control cookies? Web browsers allow some control of most cookies through the browser settings. Some web browsers provide settings that allow a user to reject cookies or to alert a user when a cookie is placed on the user’s computer, tablet or mobile device. Although users are not required to accept cookies or mobile device identifiers, blocking or rejecting them may prevent access to some features available through the Site.
How Information is Used
We may use the information we collect for any of the following purposes:
to provide the Site and Platform to you and to improve the Site and Platform;
to operate, improve, and personalize the products we offer via the Site and Platform, and to give each user a more consistent and personalized experience when interacting with us;
to provide you with information about products and the Site and Platform that we and other businesses may provide that we think may be of interest to you;
for customer service, security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the Site and Platform;
for research and analysis purposes;
to fulfill your requests, such as for additional information; and
to communicate with you.
Sharing of Information
With Third Party Service Providers Performing Activities on Our Behalf. We share your personal information with our service providers to perform the functions for which we engage them. For example, we may use third parties to host the Site or assist us in providing functionality on the Site or Platform, provide data analysis and research on the Site, send out email updates about the Site, the Platform, and products provided via the Site, and remove repetitive information from our user lists.
With Our Business Partners. When you use our Platform by scanning an Item ID of a product relating to one of our Business Partners, information relating to your use of the Platform is provided back to the Business Partner pursuant to our agreement with our Business Partners. We share your information with these Business Partners so they can provide you with information about products and websites that may be of interest to you.
For Legal Purposes. We also may share information that we collect from users as needed to enforce our rights, protect our property or protect the rights, property or safety of others, or as needed to support external auditing, compliance and corporate governance functions. We will disclose personal information as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental request or other legal or regulatory process. We may also share personal information as required to pursue available remedies or limit damages we may sustain.
Changes of Control. We may transfer information, including your personal information, in connection with a change of ownership or control by or of us or any affiliated entity (in each case whether in whole or in part).
Lucid does not share your personal information with third parties for those third parties’ direct marketing purposes, other than Device IDs and Mobile Ad IDs. Business Partners are provided with user information, but only the Business Partners for which the user opts in, sends information, or signs up for a loyalty or rewards program.
Security Used & Retention of Personal Information
Lucid uses reasonable security measures designed to prevent unauthorized intrusion to the Site and Platform and the alteration, acquisition or misuse of personal information, however, we will not be responsible for loss, corruption or unauthorized acquisition or misuse of personal information that you provide through the Site or Platform that is stored by us, or for any damages resulting from such loss, corruption or unauthorized acquisition or misuse. It is your responsibility to protect the security of your login information. We will retain your personal information for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation.

Our Site may contain links to third party websites, including those of our Business Partners. Any access to and use of such third party websites is not governed by this Privacy Policy, but is instead governed by the privacy policies of those third party websites, and we are not responsible for the information practices of such third party websites, including those of our Business Partners.
Additional Disclosures for California Residents
These additional disclosures for California residents apply only to individuals who reside in California. All phrases used under this section carry the same meaning as those phrases are used under the California Consumer Privacy Act of 2018 (“CCPA”).
A. Notice of Collection.
In the past 12 months, we have collected or may collect the following categories of personal information from California residents:
Identifiers, including name, email address, phone number account name, IP address, and an ID or number assigned to your account.
Customer records, billing and shipping address.
Demographics, such as your age or gender. This category includes data that may qualify as protected classifications under other California or federal laws.
Commercial information, including rewards redemptions and engagement with the Site and Platform.
Internet activity, including your interactions with our Site and Platform.
Audio or visual data, including pictures or vides you post on our Site and Platform.
Geolocation data, including location enabled services such as WiFi and GPS.
Inferences, including information about your interests, preferences and favorites.

Lucid does not sell the personal information of California residents, nor does Lucid have actual knowledge of selling the personal information of California residents who are 16 years or younger.
B. Right to Know and Delete.
If you are a California resident, you have the right to delete the personal information we have collected from you (subject to certain exceptions) and the right to know certain information about our data practices in the preceding 12 months. In particular, you have the right to request the following from us:
The categories of personal information we have collected about you;
The categories of sources from which the personal information was collected;
The categories of personal information about you we disclosed for a business purpose or sold;
The categories of third parties to whom the personal information was disclosed for a business purpose or sold;
The business or commercial purpose for collecting or selling the personal information; and
The specific pieces of personal information we have collected about you.
To exercise any of these rights, please email us at help@lucidgreen.io. In the request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.
C. Authorized Agent.
You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.
D. Right to Non-Discrimination.
You have the right not to receive discriminatory treatment by us for the exercise of any of your rights.
E. Notice of Financial Incentive.
When you use our Platform and scan our Business Partners’ products, you may receive certain reward points that are redeemable for free products. This information may be used by the Business Partners to send you a message, market future products, and for other internal statistical purposes. The rewards program provided by each Business Partner is independent of all other Business Partners, and is based on such Business Partner’s reasonable but sole determination of the estimated value of the personal information you provide, which takes into consideration, without limitation, estimates regarding the anticipated revenue generated from such information, the anticipated expenses which might be incurred in the collection, storage, and use of such information in the operation of the corresponding Business Partner’s business and other relevant factors related to the estimated value of such information to the corresponding Business Partner’s business, as permitted under applicable law. By providing your personal information when signing-up for the Business Partners’ rewards programs, you are affirmatively opting-in to those rewards programs. If you wish to opt-out of a rewards program with respect to any particular Business Partner, do not submit your personal information to such Business Partner. You may withdraw your consent from any rewards program at any time by contacting us or the relevant Business Partner as described above.
Additional Disclosures for Nevada Residents
Nevada law (NRS 603A.340) requires each business to establish a designated request address where Nevada consumers may submit requests directing the business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. Do Not Track; Unsubscribe; Push Notifications, App and Location Technologies
Our Site and Platform does not currently take any action when it receives a Do Not Track request. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. For details, including how to turn on Do Not Track, visit www.donottrack.us. If at any time you wish to opt-out or "unsubscribe" from receiving commercial emails related to our Platform, you may use the unsubscribe link at the bottom of each commercial email you receive. Please note that even if you opt-out of receiving commercial emails from us, we reserve the right to send transactional or relationship communications to you (e.g., if we need to contact you regarding your account status, technical support, changes to our Platform). If you have opted-in to receive push notifications on your device, you can opt-out at any time by adjusting the permissions in your device or uninstalling our Platform. You can stop all collection of information via the Platform by uninstalling the Platform. You can also reset your device Ad ID at any time through your device settings, which is designed to allow you to limit the use of your information. You can also stop all collection of location data through your device settings.
Children
We do not knowingly collect or maintain personal information from any person under the age of thirteen. No parts of our Site are directed to or designed to attract anyone under the age of thirteen.
